NFFC have already said that the Commission failed to take into account mitigating factors. (backed up by the excellent forensic Accountant who gave his very logical analysis/demolition of their decision in a recent FG podcast - which if you haven't seen it is worth watching.)
The point you make about Covid losses & promotion bonuses is an absolute disgrace & totally contrary to natural justice..........the PL knew about these for - as you say - for over a year. To disallow them at the last minute is to say the least not fair. NFFC couldn't do anything about it at such a late date.
One of the other comments made by the Commission was NFFC not accepting the offer from Athletic Madrid for Brennan Johnson........what they didn't take into account was the offer was conditional on them selling a player.........& as anybody with more than one brain cell would know getting rid of a player to sign another isn't always easy.............take Harry Ar.ter......
Absolutely second this. His explanation of the case helped me understand how incompetent the Premier League have been putting a case together.

Just a scenario if just say they turn around and give us a further reduction of say 6pts and state its for appealing. Then everton turn round and withdraw their appeal, that would be taking the piss.

I'm admittedly far from an expert on the whole subject, but I'd be absolutely shocked (but delighted) if we were given anything back, never mind 2 points. The way the initial sanction was dished out made it seem like we lucky it was only 4 points taken.

There was a guy on the Garibaldi podcast a few weeks ago. I don't know if it's the same chap.

I watched that for the first time last night, it was very illuminating. Some strong stuff in there too, e.g. he thought one could easily read an agenda into the initial decision given how they seemed to be skewing stats to suit their argument.

It's almost as if they just saw the "look how many players Forest have signed!" headlines and decided they had to punish us to avoid a precedent. Their behaviour over the timing of denying the covid losses & promotion bonuses was disgraceful.

Given this and the referee decisions recently, it's very easy to see why someone from a culture where corruption reigns could lose the plot and think "they're out to get us".

incidentally, he's a former agent infamous for losing Jennas to Paul Stretford's Proactive in the build-up to his move to Newcastle. Proactive employed Paul Hart's son (who had recently moved from Matusiewicz' Ambition Management) as well as Freddie Sheppard's son. 🤝

Narrator: Paul Hart was the selling club's manager, Freddie Sheppard was the buying club's owner.

Matusiewicz was said to have lost £250k from not being able to conclude the deal, so there was plenty of grease in the posy to keep everyone else's hands well oiled.

I bet Jermaine feels slightly awkward at the prospect of bumping into Mr Matusiewicz at the WFCG… having said that, it’s amazing how a bit of lolly helps cloud one’s conscience.

I suspect that the Sky would be salivating at us receiving an extra point deduction so there is only one point in it between the 3 potential relegation rivals with just the one team to stay up.
