My mindset is we will not get any points back but if we do get a 1 point or 2 back then it will be a massive boost but I think it is best to expect 0 points back.
I don’t expect we’ll get any points back. The only way we get points back is if the appeal panel conclude that the original Commission did any of the following:

1. Took into account aggravating factors that it should not have done.
2. Failed to take into account mitigating factors that it should have done
3. Applied a methodology for assessing the quantum of points deduction that is flawed or inconsistent with precedents.

1 is not relevant because there weren’t any aggravating factors advanced by the PL. And I don’t see there being any mileage in 3 (if anything, we should probably have had 1 more point) On 2, our best hope is to argue that until the PL disallowed promotion bonuses and our calculation of Covid losses in June 2023, we were working under the assumption that we would comply or be slightly over. However the timing of the PL’s decision not to allow these losses only gave us two weeks to do anything about it. We made a genuine attempt to do that, but did not have an unconditional offer on the table by 30 June. We then did sell Johnson in the same window. We also made further player sales in both the summer and winter windows, demonstrating intent to comply.

Our starting point was 3, with a further 3 for the size of the breach, less 2 off for early admission and cooperation. If the above mitigation was accepted, they could reduce the additional 3 points for size of breach to 2, 1 or even no points. However, I think it is be very unlikely they will disagree with the original commission on this point.

So, expecting no points back, but if we do get any, I imagine it will be due to the timing of the PL disallowing our losses.

NFFC have already said that the Commission failed to take into account mitigating factors. (backed up by the excellent forensic Accountant who gave his very logical analysis/demolition of their decision in a recent FG podcast - which if you haven't seen it is worth watching.)
The point you make about Covid losses & promotion bonuses is an absolute disgrace & totally contrary to natural justice..........the PL knew about these for - as you say - for over a year. To disallow them at the last minute is to say the least not fair. NFFC couldn't do anything about it at such a late date.
One of the other comments made by the Commission was NFFC not accepting the offer from Athletic Madrid for Brennan Johnson........what they didn't take into account was the offer was conditional on them selling a player.........& as anybody with more than one brain cell would know getting rid of a player to sign another isn't always easy.............take Harry Ar.ter......

Given what I've read & given the demolition job by Robert Matusiewicz on the Commissions document stating why we should get points deducted I'd be amazed if we don't get 1 or 2 points back. They completely ignored all of the mitigating factors of which there were many. NFFC kept them informed all the way through unlike the devious bastards at Man City & the cunning buggers at Chelsea - we cooperated. Chelsea have just sold 2 hotels they owned to a "sister company"...........this isn't much different in my humble opinion from what Mel Morris did at the home of the sheep selling Prideless Park to himself.......which he already owned. . .....
